Voted by the National Assembly last March, the bill to terminate complementary health contracts, at any time and at no additional cost, has again required the approval of the Senate before being finally adopted.
An agreement that the High Assembly granted at the beginning of this month to the great relief of contractors who have so far been confronted with a rigorous procedure, if we only quote the notice of termination to be submitted obligatorily two months before the deadline of the contract. Not to mention the important economy that could result, as proponents advocate consumer rights. An advantage whose opponents seem however less convinced.
Two-thirds of the members voted for
The break-up of a complementary health has been the subject of a lot of ink for some time. The fact is that at present, the insured must respect the annual term of the contract to terminate it under penalty of seeing it renew itself tacitly. Aware of this complex and somewhat constraining operation, the association UFC-Que Choisir supports the idea of a termination at any time and without charge. Provided, however, a minimum of one year of detention.
Amendments along these lines have been presented to the National Assembly in the form of a bill. Adopted at first reading by the Parliament on March 27, the device did not receive a favorable opinion in the Senators’ Committee. A discussion that ultimately resulted in a turnaround of these. In fact, 225 of them approved against 102 releases.
Thus, complementary health coverage will align with car and home insurance, already beneficiaries of this asset since 2014. A reform that will apply to all distributors of the contract, all statuses combined (major insurance groups, mutuals and provident institutions). According to Philippe Dallier, a member of the Senate:
“Entry into force will be no later than December 1, 2020”.
A gesture in favor of purchasing power
As a reminder, the movements of the yellow vests have put many French agglomerations to fire and blood for several months. Government measures have been put in place in response to their demands. Among them, this device would be a way to optimize the purchasing power of households.
In the same vein, the Minister of Solidarities and Health, Agnès Buzyn, was in favor of this change, believing that the majority of French people expect a reform that will have a tangible impact on their daily lives. What will be the case for this device.
It goes without saying that the cost of supplementary health insurance is an additional expense for consumers, which can not be overshadowed. But according to UFC-Que Choisir, the possibility of terminating its contract at any time and at no cost may allow policyholders to reap a global saving of 1.2 billion euros.
However, there is some opposition on the part of industry players, including unions related to the joint management of organizations and federations of complementary. According to them, the “nomadism” caused by the new regulations would encourage an increase in contributions. To the politicians Laurence Cohen and Yves Daudigny to underline:
“Strengthening competition will penalize the most vulnerable users, especially pensioners”.
